Application submitted jointly by Alaska Pain Centers of Alaska and Providence Health Systems of Alaska. Project is for approximately 20,100 square feet, for 6 operating suites and 18 pre-operative and post-operative bays for ambulatory patients. The project will be located in south Anchorage.

On February 15, 2006 Providence Alaska Health Systems filed notice of appeal of the Commissioner's Decision to deny a CON. On October 5, 2007 the Commissioner issued a final order and decision on appeal. On October 15, 2007 the joint venture appealed the Commissioner's decision to Superior Court. In 7/2008 the Superior Court overturned the Commissioner's decision and ordered a CON be awarded. The CON expiration is 12/31/09. In April 2010 Judge Torrisi ordered the CON be modified to change the
